RULES OF THE PROMOTIONAL GAME

For conducting the Promotional Game «Live your life like an idol»

Promotional game is carried out for promotion of the services rendered by Optima Media Group, hereinafter called also the “Organizer”.

1. The Organizer of the promotional Game:

4. Time frame of the Promotional Game:

1. Promotional l game «Live your life like an idol» (the Promotional Game) will run for 90 Days (14th of February until13th of May 2012).  Please check online at www.nigerianidol.com

5. Acceptance of Terms of Use

1. All participants warrant that they have read these Terms and Conditions carefully and fully understand which are on public view at www.nigerianidol.com

2. By sending an SMS with the keyword ENTER (NGN 100.00 VAT Inclusive) to the short code 34365 (the Short Code), the participants signal their complete acceptance and full understanding of these Terms and Conditions and agree:

1. to receive SMS communication from the Organizer on their mobile phones relating to the «Live your life like an idol» Promotional Game;

2. to receive SMS communication/advertising offers from the Organizer or from other companies that cooperate with the Organizer.

3. The Organizer reserves the right to cancel or amend the offer and these Terms and Conditions at any time. Any changes will be posted online at www.nigerianidol.com

4. In the event of dispute regarding the Terms and Conditions, conduct, results, and all other matters relating to the Promotional Game, the decision of the Organizer shall be final and no correspondence or discussion shall be entered into.

5. This Agreement will remain in full force and effect while the Organizer provides the offer (not taking into account temporarily suspensions of the offer for operational reasons, e.g. for repairs, planned maintenance or upgrades).

6. Participants of the Promotional Game:

1. The following are eligible to participate:

1. Natural persons (other than people employed by the Organizer for the period of the Promotional Game, and also their close relatives and spouses), who are Etisalat, Glo, MTN, Airtel or Visaphone customers during the period of the Promotional Game. If the winner is under 18, then at the delivery date of delivering the prize, the winner’s guardian must appear to collect the prize having his/her ID as well as a certification proving that he/she is the guardian.

2. The Organizer reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any provision of the Terms and Conditions.

3. By participating in the Promotional Game, entrants hereby warrant that all information submitted is true, current and complete.

7. Availability and accessibility of information and Opt-out mechanism

1. All the information for the participants of the Promotional Game with regards to the Promotional Game shall be published in www.nigerianidol.com

2. Information about the number of points (participations/chances) scored by the participants during the Promotional Game will be sent to the participants in SMS messages automatically after receiving SMS message from the Organizer. In order to know the score; each participant can send a SMS with keyword “SCORE” to 34365. (NGN 100.00 VAT Inclusive)

3. Each participant can drop out of the Promotional Game and stop receiving any information about the Promotional Game by sending an SMS with keyword “STOP” to 34365. If after the participant chooses to send a new SMS message to the Short Code, he/she will be again considered as a participant in the Promotional Game.

4. If the Promotional Game is terminated the Organizer of the Promotional Game will publish in the official resources of the Promotional Game (www.nigerianidol.com) a message about the termination of the Promotional Game.   

5. Interruption or early termination of the Promotional Game shall not release the Organizer from its obligation to give out already awarded prizes and execute other actions required, except for the cases when termination or interruption of the Promotional Game was called by actions or events which are not under the Organizer’s control

6. The Organizer of the Promotional Game shall not release personal information about participants of the Promotional Game to any third persons unless required to do so by law or in order to comply with Nigerian government entities and in accordance with the paragraph 14 of the Terms and Conditions.

7. The Organizer reserves the right not to enter into written negotiations or otherwise contact with the participants of the Promotional Game other than in accordance with the Terms and Conditions or in accordance with the requirements of the current legislation of Nigeria.

8. Regulations of participation in the Promotional Game:

1. To participate in the Promotional Game the participant must:

1. Send a blank SMS or the keyword ENTER to the Short Code 34365; (NGN 100.00 VAT Inclusive)

2. Vote for his/her favorite contestant to the short code 33680; (charged at NGN 50.00 VAT Inclusive) and participate in the Promotional Game by answering questions to the short code 34365; (NGN 100.00 VAT Inclusive)

2. Once the participant enters the Promotional Game he/she will receive a welcome message containing campaign details and a 2nd message with a question and 2 possible answers (one answer is correct and the other wrong). The participant answers the question by sending an SMS with the correct answer (which will be a numerical answer) to the Short Code.

3. The cost of each SMS sent to the voting short code 33680 is NGN 50.00 VAT Inclusive and to the trivia Promotional Game short code 34365 is NGN 100.00 VAT Inclusive. All the MT messages sent to the participants from the server are free of charge for the participants.

4. For each correct answer to the question the participant receives points, which are added up during the Promotional Game. Wrong answers give fewer points than the correct answers. The points for each right answer to the question will be added in two modes :

1. Basic Mode: In basic mode, the participant receives 20 points for each correct answer and 0 points for the wrong or invalid answer.

2. Bonus Phases: There will be bonus phases where the participant receives more points than the ones he can receive in the Basic Mode. In all cases these bonus phases will be communicated to the participant via an SMS. These phases can last from half an hour to one day and will be equally accessible to all participants.

9. Place, date, time and order of the prizes

1. The same subscriber’s number (MSISDN) cannot win the same type of prize (daily, weekly) more than once during the period of the Promotional Game.

2. The formation of participants’ record for the whole period of the  Promotional Game will start at 00:00:01 hours on the first day of the Promotional Game and end at 23:59:59 hours on the last day of the Promotional Game.

3. Draws will be conducted at the dreams studio which is being used for the Nigerian Idol Show, and the draw will be done in the presence of a personnel from the Nigeria Lottery Regulatory Commission (NLRC) and the audience during the result show production.

4. Daily prize

1. Every day of the Promotional Game, one (1) participant wins up to 2,000,000 NGN. The Daily prize will be awarded via a lucky draw. Every subscriber who on that day sent at least 1 SMS enters the draw with 1 entry (one chance of winning); regardless the number of SMS he/she has sent. The participant who is designated as daily winner will win 20,000 NGN for every SMS sent on that day up to 2,000,000 NGN. E.g. If the winner of a single day has sent 10 SMS on that day, he will win 200,000 NGN. If someone has sent 101 SMS, he/she will win 2,000,000 NGN.

2. A daily prize winner cannot win another daily prize, but he/she can win a weekly (Sunday) prize, and the Grand prize.

5. Weekly prize

1. Every Sunday of the «Live your life like an idol» Promotional Game, one (1) participant wins up to 4,000,000 NGN. Sunday prizes will be awarded via a lucky draw. Every subscriber who on that Sunday sent at least 1 SMS enters the «Live your life like an idol» draw with 1 entry, regardless of the number of SMS he/she has sent. The participant who is designated as daily winner will win 40,000 NGN for every SMS sent on that day and up to 4,000,000 NGN. E.g. If the winner has sent 6 SMS on that Sunday, he/she will win 240,000 NGN.

2. A Sunday prize winner cannot win another weekly (Sunday) prize, but he/she can win a daily prize, and the Grand prize.

6. Grand prize

1. The winner of the grand prize is determined after the end of the Promotional Game via a draw. Every subscriber who sent at least 1 SMS during the whole period of the Promotional Game enters the «Live your life like an idol» draw with 1 entry, regardless of the number of SMS he/she has sent. To enter the draw for the grand prize, a participant does not have to send an SMS on the last day. The amount of prize cash given will depend on the points the winner gathered until the end of the Promotional Game. Below you will find the table which relates the points gathered with the exact amount of money given to the winner.

2. The winners are notified by OMG via phone call to their subscriber number. The winners will receive notice within 15 calendar days from the date of the draw. The name and initials, or name of the organization of the winners may be announced by ads or via SMS to all the participants included in the record.

2. Terms of the prizes:

1. All prizes will be awarded within 90 of the last day of the Promotional Game.

2. The exact date and place of the provision of the prizes shall be published on the official website www.nigerianidol.com .

3. The winners are responsible for payment of due taxes and collections for the prizes under any relevant current legislation.

4. The winners will be contacted by the Organizer. The winners must confirm in writing that they are the legal holder of the subscription and that they are entitled to the prize and shall complete all the necessary documents provided by the Organizer.  All winners must provide identification documents in order to receive the prize.  Prizes may be received by a representative of the winner by proxy upon written confirmation from the winner.

5. By participating in the Promotional Game, the winners agree that any of their data, including names, surnames, photos and video images, can be used by the Organizer for advertising purposes with no prior consent of the winner and free of charge.

6. The Organizer will select up to 5 runner-up winners and if the notified winner refuses the prize or fails to appear to collect it within 10 calendar days of notification, then the Organizer will contact one of the relevant runner-up winners that they have won the prize. If none of the runner-up winners accept the prize or do not show up with 10 calendar days of notification then the prize will remains the property of the Organizer of the Promotional Game.

7. Decisions made by the Organizer will be final and no correspondence will be entered into. Prizes are not transferable.

3. Limitation of liability

1. The Organizer accepts no responsibility whatsoever for, including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control and execution.

2. The Organizer reserves the right to whenever is deemed necessary temporarily suspend the Promotional Game for operational reasons (e.g. for repairs, planned maintenance or upgrades). The Organizer promises to restore the Promotional Game as soon as possible after any temporary suspension period.

3. The Organizer will deliver the prizes to the winners via bank transfer.

4. The Organizer advises participants to use caution and common sense when participating in the Promotional Game at all times.

4.  Disclaimer of warranties

1. Participants understand and agree that they participate in this Promotional Game at their own risk and willingness and have not been coerced in any manner to enter the Promotional Game.

2. The Organizer makes no warranty, implied or express, that any part of the Promotional Game will be uninterrupted and error-free. 

3. Neither the Organizer nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant participating in the promotion or as a result of accepting the prize.  

4. The Organizer is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Promotional Game.

5. By entering the Promotional Game, participants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against the Organizer, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or user of any prize, including without limitation, personal injuries, death and property damage.  

5. Data protection and Publicity

1. Personal data related to voice, image, name or address and any other relevant information will be included in a filing system belonging to the Organizer as data controller, and can be used for taking part in the competition as well as publicity mailing, or other purposes relating to the Organizer’s services, unless otherwise indicated.

2. The Organizer will use such data in a confidential manner and participants could exercise the rights of access, rectification, delete and objection to prior consent for sending publicity through a written communication addressed to the Organizer, via e-mail to info@cellcast360.com

3. Participants agree that if they win a prize then their first name and the first [6] digits of their subscriber mobile phone number will be published for informational purposes only.

6. Governing Law

1. In any case of disagreement arises participants can present their complaint to the Organizer and the issue will be decided in accordance with the laws of Nigeria.
